I ordered a flashlight way before christmas and it was dead on arrival. The seller claims they sent a replacement part on Dec 21st but I haven't got it yet. They have no proof that they sent it and obviously I have no proof that they didn't send it.
Did you paypal? File a claim is your first step.
If they didnt send a tracking number then obviously imho they didnt send it.

No tracking number because it went through the post office. I already fixed the flashlight and gave it as a christmas present, so it can't go back to the seller for a refund.
Post office does use tracking numbers too FWIW.
If it were me I would file a claim thru paypal and see where it goes, cant do much worse than no flashlight.

X2 on filing a claim. I've done it a few times with great results. I think you'll have the best results if it's a business or store versus a random person selling something prevately.
